USAID pledges to help Vietnam in civil judgment enforcement
The US Agency for International Development (USAID) will make every effort to assist Vietnam in improving the efficiency of civil judgment enforcement, said a USAID official.
Hanoi(VNA) – The US Agency for International Development (USAID) will make everyeffort to assist Vietnam in improving the efficiency of civil judgment enforcement,said a USAID official.
David Anderson,director of the USAID’s state administration project, said at a workshop inHanoi on June 4 that the agency has cooperated with the Ministry of Justice andother ministries, agencies and businesses of Vietnam to complete a legalframework for business activities.
Such efforts paidoff, he said, citing the World Bank’s Doing Business report which showed Vietnamjumped 14 places in the business environment rankings in 2017 compared with theprevious year.
However, there remainsmuch work to do to raise the efficiency of the settlement of contract disputes,including civil judgment enforcement, the official noted.
Other delegates atthe workshop pointed out bottlenecks in regulations and administrativeprocedures in civil judgment enforcement.
Le Thi Kim Dungfrom the General Department of Civil Judgment Enforcement under the JusticeMinistry mentioned sluggish settlement of complaints and prolonged enforcement dueto inadequate legal documents.
Given this, shesuggested issuing more legal documents to enable executors and judgmentenforcement agencies to participate in or access information about the judgmentprocess, making enforcement work easier.
Lawyer Nguyen HungQuang underlined the need to clearly stipulate administrative procedures incivil judgment enforcement to save time and money.
He said performingadministrative procedures online will improve efficiency and be welcomed by citizensand businesses.
Many experts atthe workshop proposed clarifying the responsibility of agencies andorganisations to coordinate in implementing the requests of civil judgmentagencies, revising relevant legal regulations and popularising laws.
According toNguyen Van Son, deputy head of the General Department of Civil Judgment Enforcement,between October 2017 and March 2018, some 635,198 civil cases were brought tocourt, an increase of 8.82 percent year-on-year.-VNA
The National Assembly Standing Committee on April 21 scrutinised a Government proposal on revisions and amendments to the Law on Enforcement of Civil Judgements.
The Law on amendments and supplements to some articles of the Law on enforcement of civil judgements was adopted by lawmakers during their plenary session in Hanoi on November 25, with 84.1 percent of votes.
While handling pledged assets is considered an effective tool for credit institutions to retrieve debts and reduce non-performing loans, gaps in regulation have been hindering progress on this front.
The adoption of a one-door mechanism at civil judgement enforcement agencies must be expedited across the country to allow the judicial systems to go online, officials said.
According to the Central Committee of the Vietnam Red Cross Society (VRC), this year’s campaign provided long-term aid for 3,785 individuals and organisations. Support included houses, clean water systems, school meal facilities, books, and livelihood assistance, with a total value of more than 118 billion VND.
The programmes have brought about positive changes to rural infrastructure, comprehensively improved the material and spiritual lives of farmers, and contributed to Vietnam's economic restructuring, said PM Pham Minh Chinh.
The festival highlighted the contributions and robust development of Vietnam's revolutionary press over the past century while promoting press products and showcasing the creativity of Vietnamese journalists.
The programme on sustainable poverty reduction has achieved its annual targets for reducing the poverty rate as assigned by the National Assembly and the Government.
